Memory Vault is operated by 汕尾市城区无题贸易有限公司 (the “Operator,” “Memory Vault,” “we,” “us,” or “our”). Registered office: Room 210-11610, Building 2, Guangming Innovation and Entrepreneurship Center, No. 09 Sanhe Road, Hongcao Park, Shanwei High-tech Zone, Shanwei City, Guangdong Province, China (汕尾市汕尾高新区红草园区三和路09号光明创新创业中心2号楼210室-11610；自主申报、集群登记). 2. Acceptance and eligibility
By accessing Memory Vault, purchasing a Gift Pass, redeeming a code, or creating or viewing a gift, you agree to these Terms and our Privacy Policy. Purchasers must be at least 18 years old and legally able to enter into a contract. If you create a gift for a minor, you confirm that you have the necessary authority and permissions for all submitted content.
3. The service
Memory Vault lets a purchaser buy a one-time Gift Pass, redeem its unique code, create a personalized interactive digital gift, publish it, and share it by link or QR code. Features vary by the plan shown at checkout:
- Classic — US$6.99: up to 8 photos, a personal letter, up to 5 reasons, music link, shareable link and QR code, with 3 months of hosting.
- Signature — US$14.99: up to 20 photos, up to 10 reasons, Signature templates and timeline or countdown features, with 1 year of hosting.
- Cinematic — US$24.99: up to 30 photos, supported video and voice features, richer reveal options, and up to 3 years of hosting.
The product page and checkout shown when you order form part of these Terms. We may reasonably improve or change presentation and non-essential features, but will not materially reduce the paid hosting term or core entitlement for an existing purchase.
4. Orders, payment, and delivery
Prices are displayed before payment. Waffo Pancake acts as merchant of record and payment processor for transactions. Its checkout may collect billing information, calculate applicable taxes, issue receipts, and apply its own payment terms. Memory Vault does not receive or store your full card number.
After successful payment, a unique Gift Pass code is generated and displayed on the confirmation page. Delivery is normally immediate, but security checks, network issues, or payment confirmation delays may occasionally slow delivery. Keep your order ID and the email used at checkout so that the code can be recovered.
5. Gift Pass codes
A Gift Pass code is valid for one redemption and the plan purchased. It may be given to the intended gift creator but must not be sold, duplicated, guessed, scraped, or used fraudulently. You are responsible for keeping the code and order details secure before redemption. We may disable or replace a code where we reasonably suspect fraud, payment reversal, technical duplication, or unauthorized use.
6. Your content and permissions
You retain ownership of the text, photos, audio, video, links, and other material you submit (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, process, reproduce, display, and transmit Your Content only as needed to operate, secure, support, and deliver your gift.
You confirm that you own Your Content or have permission to use it, including permission from identifiable people where required. You must not submit content that is illegal, infringing, deceptive, threatening, hateful, sexually exploitative, privacy-invasive, malicious, or otherwise harmful. We may restrict or remove content when reasonably necessary to comply with law, protect people or systems, or enforce these Terms.
7. Publishing, links, and hosting period
A published gift receives a public, hard-to-guess link and may also be represented by a QR code. Anyone who receives that link or QR code may be able to view the gift, so share it only with people you trust. A hard-to-guess link is not the same as account-based access control.
The hosting period begins when the gift is first published, unless the product page states otherwise. After the applicable hosting period ends, the gift may stop working and its content may be deleted. Download or retain your original files separately; Memory Vault is not a permanent archival or backup service.
8. Cancellations, refunds, and payment disputes
You can abandon checkout before payment without charge. Because a unique digital Gift Pass is delivered immediately, completed purchases are generally final once the code has been redeemed or a gift has been created or published, except where a refund is required by law.
If a code has not been redeemed, you may request cancellation within 7 days of purchase by contacting byst001999@outlook.com with the order ID and checkout email. For a defective code or a material service failure, contact us within 14 days of discovery. We will investigate and, where appropriate, repair the service, replace the code, extend hosting, or arrange a refund through Waffo Pancake. Nothing in this section limits mandatory consumer rights.
9. Availability and acceptable use
We aim to keep Memory Vault available, but do not promise uninterrupted or error-free service. Maintenance, internet failures, third-party outages, security events, or circumstances outside our reasonable control may affect availability. You must not interfere with the service, bypass limits, probe security, automate abusive requests, introduce malware, or use the service for unlawful or commercial resale purposes.
10. Intellectual property
Memory Vault’s software, templates, branding, design, and original materials are owned by or licensed to us. Except for Your Content and the personal gift output created through the service, these Terms do not transfer any intellectual property rights to you. You may use your finished gift for personal, non-commercial sharing.
11. Disclaimers and liability
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We do not guarantee that every device, browser, third-party music link, or external service will remain compatible. We are not responsible for losses caused by content you provide, links you share, unauthorized disclosure by a recipient, or third-party services outside our control.
To the maximum extent permitted by law, our total liability arising from a purchase will not exceed the amount you paid for that purchase. We do not exclude liability that cannot legally be excluded, including mandatory consumer remedies.
12. Suspension and termination
We may suspend access to a code or gift where reasonably necessary to address fraud, chargebacks, illegal content, security risk, or a serious breach of these Terms. Where practical, we will explain the reason and give you an opportunity to contact support.
13. Governing terms and changes
These Terms are governed by the laws applicable at the Operator’s registered office, without depriving consumers of mandatory protections available in their country of residence. Payment transactions may also be subject to Waffo Pancake’s checkout terms. If we make material changes, we will update the date above and publish the revised Terms. Changes do not retroactively remove rights already attached to a completed purchase.
